When do you need Personal Document Attestation, DFAT Legalisation (Apostille & Authentication) and Personal Document Notarisation?

Some overseas authorities require personal documents to be legalised by the Australian Department of Foreign Affairs and Trade (DFAT) before the documents can be accepted by the authorities. Common types of personal documents that are required to be legalised include birth certificates, marriage certificates, death certificates and passports.

In many countries, if you intend to travel overseas to get married, you will need to obtain a Certificate of No Impediment to Marriage (CNI). Authorities overseas may ask for a CNI to prove you’re free to marry. You may require a Single Status Certificate, No Record Result Certificate or Divorce Certificate, which are available in your state’s Registry of Births, Deaths and Marriages.

DFAT legalises personal documents by issuing either an Apostille or an Authentication certificate on the document. 

Apostilles are used for countries that are signatories to the Hague Convention*.
Authentication certificates are used for countries that are not signatories to the Hague Convention*. 

DFAT can legalise two sorts of personal documents:
Original documents: Permitted only if the original personal documents has been issued by the official issuing authority. 
Notarised documents: DFAT can legalise all notarised personal documents sealed with a Notarial Certificate without any further verification by the official issuing authority.

We do not recommend you to use your original documents for your DFAT Legalisation and Embassy Attestation process. You should use a notarised copy to prevent the risk of your original documents being lost or destroyed.

For non-Hague Convention countries, DFAT authenticated documents must then be attested by the relevant Embassy or Consulate in Australia.

* The Convention of 5 October 1961 Abolishing the Requirement of Legalisation for Foreign Public Documents (HCCH 1961 Apostille Convention).
